(a) Nothing in these Rules shall exonerate any vessel, or the owner, master or crew thereof, from the consequences of any neglect to comply with these Rules or of the neglect of any precaution which may be required by the ordinary practice of seamen, or by the special circumstances of the case. (b) In construing and complying with these Rules due regard shall be had to all dangers of navigation and collision and to any special circumstances, including the limitations of the vessels involved, which may make a departure from these Rules necessary to avoid immediate danger.

What does COLREG Rule 2 say about responsibility?

Nothing in these Rules exonerates any vessel, or her owner, master or crew, from the consequences of any neglect to comply with the Rules or of the neglect of any precaution required by the ordinary practice of seamanship, or by the special circumstances of the case (Rule 2(a)).

Can a vessel depart from the COLREGs to avoid immediate danger?

Yes. Rule 2(b) requires due regard to all dangers of navigation and collision and to any special circumstances, including the limitations of the vessels involved, which may make a departure from these Rules necessary to avoid immediate danger.

Does good seamanship require more than following the COLREGs?

Yes. Rule 2 makes a vessel answerable for neglecting any precaution required by the ordinary practice of seamanship, so compliance with the Rules alone does not relieve her of responsibility. Blindly following the Rules without considering the specific situation is the classic Rule 2 failure.
